Privacy Policy

Art of Media Design, LLC (“Art of Media Design,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains what personal data we collect through our website (ArtOfMediaDesign.com) and services, how we use and share that data, and your rights regarding your information. By using our website, you agree to the practices described in this Privacy Policy. We comply with applicable global privacy laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

Data Collection

Personal Information You Provide: We collect personal information that you voluntarily provide to us:

  • Contact Form Data: When you submit a project inquiry via our contact form, we collect information such as your name, email address, phone number, and any details you include about your project or business needs.

  • Email Subscription Data: If you sign up for our email list or newsletter, we collect your email address (and possibly your name) to send you updates.

  • Note: We do not create user accounts on our site, so we do not collect usernames, passwords, or payment information through the website.

Information Collected Automatically: When you visit our site, certain data is collected automatically:

  • Cookies and Usage Data: We use cookies and similar technologies (like browser caching) to enhance site performance and collect analytics information. Cookies are small text files placed on your device to store data and identify your browsergdpr.eu. For example, our site may use a cookie to remember your preferences for faster loading, and Google Analytics uses cookies to track how you navigate and use our sitetermsfeed.com. This usage data may include your IP address, browser type, pages viewed, and the date/time of your visits.

  • Device and Technical Data: Our systems and third-party analytics may log technical information when you access the site. This can include your IP address, operating system, browser version, and other device identifiers, as well as how you interacted with our site (e.g. pages visited, time spent). This data is generally aggregated and not used to personally identify you, but under some laws (like GDPR) it may be considered personal data.

We do not knowingly collect sensitive personal information (such as government ID numbers, financial account details, or data about children under 13) through our website. If you believe a child under 13 has provided personal data to us, please contact us so we can remove it.

Use of Cookies and Caching

Our website uses cookies and caching technologies to improve your browsing experience and site loading performance. Cookies are small text files stored on your computer or device when you visit certain websites. We use cookies for functions such as:

  • Performance and Functionality: to remember your preferences and improve load times. For instance, caching may store parts of our site in your browser so pages load faster on repeat visits.

  • Analytics: to understand how visitors use our site. We utilize Google Analytics, which places its own cookies to collect usage data (e.g., pages you visit, clicks made, and time spent)termsfeed.com. This helps us analyze web traffic and improve our services. The data collected via Google Analytics is aggregated and does not directly identify individual users.

We do not use cookies for advertising or tracking you across other websites, and we do not use cookies to collect sensitive information. You can control or delete cookies through your browser settings at any time. Most browsers allow you to refuse new cookies, disable existing cookies, or alert you when new cookies are set. Please note that if you disable cookies, certain features of our site (such as interactive features or cached speed improvements) may not function properlygdpr.eu. For more information about cookies and how to manage them, you can visit external resources like AllAboutCookies.org.

Data Usage

We use the personal data we collect for the following purposes:

  • Providing and Improving Services: We use your information to respond to your inquiries and provide the web design services or information you request. For example, details you share in a contact form enable us to discuss your project with you. We may also use data to improve our website’s functionality, content, and user experience.

  • Communication: We may use your contact information to communicate with you. If you filled out our contact form, we will use your email or phone number to reply to your inquiry or provide project proposals. If you subscribed to our mailing list, we will send you newsletters or marketing emails about our services or relevant updates. (You can opt out of these communications at any time by clicking an unsubscribe link or contacting us directly.)

  • Analytics and Performance: We analyze usage data (collected via cookies and Google Analytics) to understand how our site is usedtermsfeed.com. This helps us troubleshoot performance issues, monitor traffic levels, and make informed decisions about website improvements and content. All analytics are used in aggregate form and do not identify you personally.

  • Legal Compliance and Protection: We may process and retain personal information as needed to comply with our legal obligations (for example, maintaining records for accounting/tax purposes or responding to lawful requests by authorities). We may also use or disclose information to enforce our Terms of Service, to prevent fraud, to resolve disputes, or to protect our rights, safety, and property or those of our customers and others.

We will not use your personal data for purposes that are incompatible with the ones outlined above without obtaining your consent. If we intend to process your data for a new purpose, we will provide you with notice and, if required, seek your permission.

Data Sharing

We value your privacy. Accordingly, we do not sell or rent your personal information to third parties for their own marketing or commercial purposesedurightslaw.com. We also do not share your data with unrelated third parties except in the limited circumstances described below:

  • Service Providers: We may share your information with trusted third-party service providers who help us operate our business and the website. This includes, for example, our website hosting provider, analytics services (such as Google Analytics), or an email distribution service if we send newsletters in the future. These service providers process data on our behalf and are contractually obligated to protect it and use it only for the services they perform for us. They cannot use your data for their own purposes. (For instance, Google Analytics may process usage data for analytics, but it cannot share that data except as allowed in its agreement with us and privacy laws.)

  • Future Email/Marketing Services: As of now, we handle any email communications in-house and do not use third-party email marketing platforms. If we decide to use a third-party email service (for example, to manage newsletter subscriptions) in the future, we will update this policy and ensure that any such provider is reputable and complies with privacy regulations.

  • Legal Requirements: We may disclose personal information if we are required to do so by law or legal process. For example, we might have to share data in response to a court order, subpoena, or government investigation. We will also disclose information if necessary to investigate or enforce legal rights and agreements, or to protect ourselves, our customers, or others from harm or illegal activities.

  • Business Transfers: In the event that Art of Media Design undergoes a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, the personal information we have collected may be among the assets transferred. We will ensure the confidentiality of any personal data involved in such a transaction and provide notice before it is transferred or becomes subject to a different privacy policy.

  • With Your Consent: In situations where you have explicitly given us consent to share your information with a third party (for example, if we co-host an event or webinar and you agree to share contact info with a partner), we will share it as directed by you. In such cases, we will make clear why and with whom your data will be shared.

Aside from the above, Art of Media Design will not share your personal data with any third parties. We do not share personal information for third-party advertising purposesedurightslaw.com. If in the future we need to share data for any new reason, we will obtain your permission or at least provide you with notice and the opportunity to opt out, as required by law.

User Rights (GDPR & CCPA)

We respect the rights you have regarding your personal information. Depending on where you live, you may have specific legal rights under privacy laws such as the GDPR (for individuals in the European Economic Area) or the CCPA (for California residents). This section outlines those rights and how you can exercise them:

Rights Under the GDPR (for EU/EEA Individuals): If you are located in the European Union, the European Economic Area, or another jurisdiction with similar data protection laws, you have the following rights with regard to your personal data:

  • Right of Access: You have the right to request a copy of the personal data we hold about you, and to obtain information about how we process itgdpr.eu.

  • Right of Rectification: If any personal information we have is incorrect or incomplete, you have the right to ask us to correct or update itgdpr.eu.

  • Right to Erasure: You can request that we delete your personal data in certain circumstances (for example, if the data is no longer necessary for the purposes it was collected, or if you withdraw consent and no other legal basis for processing applies)gdpr.eu. This is also known as the “right to be forgotten.” Please note that this right is not absolute – sometimes we may need to retain certain information for legal or legitimate business reasons (we will inform you if so).

  • Right to Restrict Processing: You have the right to ask us to restrict or pause the processing of your personal data under certain conditions (for instance, while we are verifying the accuracy of your data or if you have objected to our processing)gdpr.eu. When processing is restricted, we can still store your information but will not use it further until the restriction is lifted.

  • Right to Object: You have the right to object to our processing of your personal data in certain situations. In particular, you can object to processing done for our legitimate interests or for direct marketing purposesgdpr.eu. If you object, we will stop processing your data unless we have a compelling legitimate ground to continue or if it is needed for legal claims.

  • Right to Data Portability: You can request a copy of the personal data you provided to us in a common, machine-readable format, and you have the right to have that data transmitted to another organization, where technically feasiblegdpr.eu. This right applies when your data is processed by us based on your consent or for the performance of a contract with you.

  • Right to Withdraw Consent: If we are processing your personal information based on your consent, you have the right to withdraw that consent at any time. For example, if you subscribed to our mailing list and no longer wish to receive emails, you can unsubscribe (withdrawing consent will not affect the lawfulness of any processing we did prior to your withdrawal).

  • Right to Complain: If you believe we have infringed your data protection rights, you have the right to lodge a complaint with a supervisory data protection authority in your country. We would, however, appreciate the chance to address your concerns directly before you do this, so please consider contacting us first.

We will respond to valid GDPR requests within one month, as required by lawgdpr.eu (this period may be extended by an additional two months for complex requests, but we will inform you if an extension is needed). Exercising these rights is free of charge. However, if requests are manifestly unfounded or excessive (for example, repetitive), we may charge a reasonable fee or refuse to act on the request as permitted by the GDPR.

Rights Under the CCPA (for California Residents): If you are a California resident, you are entitled to certain rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to know what personal information we collect about you, the categories of sources of that information, the purpose for collecting it, and the categories of third parties with whom we share itoag.ca.gov. You may request that we disclose to you the specific pieces of personal information we have collected about you over the past 12 months.

  • Right to Delete: You have the right to request that we delete personal information we have collected from you (with certain exceptions)oag.ca.gov. Once we receive and confirm a verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. For example, we may retain information needed to complete a transaction you requested, to detect security incidents, to comply with a legal obligation, or other CCPA-recognized exceptions.

  • Right to Opt Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information to third partiesoag.ca.gov. However, please note that Art of Media Design does not sell your personal information (as “sell” is defined by the CCPA, which includes renting, disclosing, or transferring personal data for valuable considerationcookiebot.com). We also do not share your personal information for cross-context behavioral advertising. Because we do not sell or share personal data in this manner, the opt-out right is largely not applicable to our operations. If in the future we ever considered selling personal data, we would provide a clear “Do Not Sell or Share My Personal Information” link on our website as required by law.

  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of your CCPA rightsoag.ca.gov. This means we will not deny services to you, charge you a different price, or provide a different level of quality of services just because you exercised your privacy rights under CCPA. We treat all customers equally, regardless of any privacy requests made.

  • Right to Correct (CPRA addition): Effective January 1, 2023, California residents also have the right to request that we correct any inaccurate personal information we hold about youoag.ca.gov. If you discover that any of your personal details are incorrect, please let us know and we will gladly make corrections (after verifying your identity and the accuracy of the new information).

  • Right to Limit Use of Sensitive Personal Information (CPRA addition): You have the right to limit how we use or disclose “sensitive personal information” about you if we collect such dataoag.ca.gov. Sensitive personal information under California law can include data like precise geolocation, racial or ethnic origin, health information, etc. However, we do not collect or process sensitive personal information as defined by the CCPA/CPRA in the context of our website and services. In the unlikely event we ever did, we would honor your right to limit use/disclosure of such data.

Exercising Your Rights: To exercise any of the privacy rights described above or to inquire about your personal data, please contact us using the information in the Contact Information section below. For GDPR requests, please specify which right you wish to exercise. For CCPA requests, you (or an authorized agent acting on your behalf) can submit a verifiable consumer request. We will need to verify your identity (and, if applicable, authority of your agent) to a reasonable degree of certainty before fulfilling requests, in order to protect your information. This may involve confirming information we already have on file for you (such as sending a reply from the email address you provided, etc.). We will respond to privacy rights requests within the timeframes required by law (generally within 30-45 days). If we need more time, we will inform you of the reason and extension period in writing.

We are committed to honoring your rights and ensuring your satisfaction. We will not charge you for making a request unless it is excessive, repetitive, or manifestly unfounded, in which case we may charge a reasonable fee or decline the request as permitted by law. If you have any questions about your privacy rights or how to exercise them, you can always reach out to us for assistance.

Data Security

We take the security of your personal information very seriously. Art of Media Design, LLC implements reasonable administrative, technical, and physical security measures designed to protect your personal data from unauthorized access, loss, misuse, or disclosure. These measures include, for example:

  • Using secure server environments with firewall protection.

  • Employing encryption (HTTPS/TLS) for data transmitted on our site (when you submit information through our contact form, it is sent to us over an encrypted connection).

  • Limiting access to personal data to only those employees or contractors who need it to perform their work, and subjecting them to confidentiality obligations.

  • Regularly updating our website software and monitoring for potential vulnerabilities or attacks.

Despite our efforts, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security. Cyber threats evolve rapidly, and there is always some risk that a breach could occur. In the unlikely event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by applicable law.

We encourage you to take steps to keep your own information secure as well. Make sure not to send sensitive personal data through insecure channels, and contact us immediately if you suspect any unauthorized access to your information related to our company.

Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Art of Media Design website and any related services. Please read these Terms carefully. By using our website (ArtOfMediaDesign.com) or engaging our services through the site, you agree to be bound by these Terms, as well as our Privacy Policy (above). If you do not agree to these Terms, please do not use our site or services.

Acceptance of Terms

By accessing or using the Art of Media Design website (the “Site”), you acknowledge that you have read, understood, and agree to these Terms of Service. This agreement is between you (“the user”) and Art of Media Design, LLC (“the Company,” “we,” or “us”). If you do not agree with any part of these Terms, you must not use the Site.

Use of the Site is also subject to our Privacy Policy, which describes how we collect and handle your information. The Privacy Policy is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.

Eligibility: The Site is intended for users who are at least 18 years old. By using our Site, you affirm that you are 18 or older, or if you are under 18, that you are using the Site with the consent and supervision of a parent or legal guardian. We do not knowingly offer our services to or collect personal data from children under 13 years of age (see our Privacy Policy for more details).

Geographic Use: Art of Media Design, LLC is based in the United States, and our Site is controlled and operated from our offices in New York. We make no representation that the content or services on our Site are appropriate or available for use in other locations. If you choose to access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with any local laws that apply, if and to the extent such laws are applicable. We reserve the right to limit the availability of the Site or any content or service described on the Site to any person, geographic area, or jurisdiction, at any time and at our sole discretion.

Modification of Terms: We may update or revise these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last Updated” date at the top. It is your responsibility to review these Terms periodically. Your continued use of the Site after any changes are posted constitutes your acceptance of those changes. If you do not agree to a change in the Terms, you must stop using the Site.

Service Descriptions

Art of Media Design, LLC is a professional web design company that offers global website design and related digital media services. Through our Site, we provide information about our services, showcase examples of our past projects (portfolio), and offer a means for prospective clients to contact us for project inquiries. We strive to ensure that all descriptions of our services, pricing (if listed), and content on our Site are accurate, current, and presented clearly. However, all information on the Site is provided for general informational purposes only and is not guaranteed to be complete or free of errors.

No Guarantee of Availability: The services and service descriptions on our Site do not constitute a binding offer or contract. Engaging our company for a web design project requires a separate agreement outlining the project scope, fees, timelines, and other terms, which will be negotiated and signed by both you and Art of Media Design. The content on the Site is not intended to form any part of such a contract unless explicitly incorporated. We reserve the right to refuse service or decline project inquiries at our discretion, even if they are submitted through our Site.

Changes to Services: The offerings, materials, and examples on the Site are subject to change. We may add, remove, or modify service offerings or any content on the Site at any time without prior notice. For instance, we might update the design portfolio, adjust service packages, or correct inaccuracies. Such changes do not require notice to users, and they become effective when posted on the Site.

Not Professional Advice: Any informational content on our Site (such as blog articles, guides, or FAQs, if provided) is for general information only. While we aim to provide helpful and accurate information about web design and related topics, nothing on the Site should be taken as professional advice specific to your situation. Always consult directly with us or another qualified professional for advice tailored to your needs before making decisions based on site content.

Client Responsibilities: If you choose to engage Art of Media Design for services after contacting us, you will likely enter into a formal agreement. At that time, you will have certain responsibilities (for example, providing necessary materials and feedback in a timely manner, and paying agreed fees). Those responsibilities will be outlined in the separate agreement and are not governed by these website Terms of Service. However, when using this Site to communicate with us, you agree to provide true, accurate, and non-misleading information about yourself and your project. Do not submit unlawful content or violate any other section of these Terms when communicating via our Site.

Intellectual Property

Unless otherwise indicated, the Site and all content and materials on the Site — including but not limited to text, images, graphics, logos, icons, videos, software, and overall design/layout — are the proprietary property of Art of Media Design, LLC or are used under license or with permissionglidedesign.com. This content is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws. All trademarks, service marks, and logos displayed on the Site (including the name Art of Media Design and our company logo) are owned by Art of Media Design, LLC, except as otherwise noted. You are not granted any license or right to use any of these trademarks without our express written consent.

Limited Personal Use License: We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and its content for your own personal, informational, and non-commercial use. This means you may view, download, or print pages from our Site for your personal use (for example, to consider our services or keep a record of information) provided that you do not remove or obscure any copyright, trademark, or other proprietary notices. No other use is permitted without our prior written permission.

Prohibited Uses of Content: You may not copy, reproduce, distribute, publicly display, republish, upload, post, transmit, or create derivative works from any of the content on our Site without our express prior written consent. For example, you are not allowed to:

  • Reuse text or images from our Site for any commercial purpose (such as on your own website or marketing materials) without permission.

  • Modify or reverse-engineer any part of the Site or its underlying software.

  • Use our graphics or logos as hotlinks or to imply endorsement or partnership without authorization.

Any unauthorized use of Site content may violate copyright laws, trademark laws, privacy and publicity laws, and/or communications regulations and statutes. Art of Media Design, LLC reserves all rights not expressly granted to you in these Terms. If you wish to seek permission for a use of our content that these Terms do not explicitly allow, please contact us.

Third-Party Content: The Site may contain content that is owned by third parties. For example, we might display client logos, third-party trademarks, or licensed stock images as part of our portfolio or design examples. Such third-party content remains the property of its respective owners and is used on our Site for descriptive or illustrative purposes. Your use of any third-party content may be subject to that third party’s terms. Nothing in these Terms grants you rights to any third-party intellectual property displayed on our Site.

Feedback and Submissions: If you choose to submit feedback, ideas, or suggestions to us (for example, suggestions on improving our services or website), you agree that we can use and share such feedback for any purpose without compensating you. Do not send us any ideas or materials that you consider confidential or proprietary; we cannot accept responsibility to protect such information unless we have separately agreed in writing to do so.

Limitation of Liability

Use at Your Own Risk: Your use of our Site and services is at your own risk. To the fullest extent permitted by applicable law, Art of Media Design, LLC and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your access to or use of (or inability to use) the Site or our services. This includes, without limitation, any damages for lost profits, lost data, business interruption, or loss of goodwill, even if we have been advised of the possibility of such damages.

Total Liability Cap: To the fullest extent permitted by law, the total aggregate liability of Art of Media Design, LLC for any claims arising out of or relating to these Terms, the Site, or our services will not exceed the amount (if any) that you paid to us for services in the six months preceding the event giving rise to the liability. If you have not paid us any amount (for example, if you have only used the free information on our Site), our total liability to you shall be zero for any and all claims.

No Liability for Certain Types of Loss: In particular, and without limiting the generality of the foregoing, Art of Media Design will not be liable for any harm to your computer system or device, loss of data, or other damage that results from your access to or use of the Site (for example, from downloading any content or materials from the Site). We try to ensure our Site is free of viruses or other harmful components, but we cannot guarantee this. It is your responsibility to use appropriate safeguards (like up-to-date antivirus software) to protect your own system.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (for example, in certain circumstances liability for willful misconduct or gross negligence cannot be limited, or consumers might have non-waivable rights under local law). If any law that applies to you does not allow the exclusion or limitation of liability as described in this section, then those exclusions/limitations will apply to you only to the extent permitted by law. In such cases, if liability cannot be fully disclaimed, it will be limited to the smallest amount or narrowest scope allowed by applicable law.

Disclaimers

“As-Is” Basis: The Site and all content, services, and features on the Site are provided “AS IS” and “AS AVAILABLE”. Art of Media Design, LLC disclaims all warranties of any kind, either express or implied, to the fullest extent permitted by lawglidedesign.com. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or usage of tradeglidedesign.com. We make no guarantee that the Site will meet your expectations or requirements.

No Warranty on Content: While we strive to provide accurate and up-to-date information, we do not warrant the accuracy, completeness, or usefulness of any information on the Site. Any reliance you place on such information is strictly at your own risk. The content on the Site may contain technical inaccuracies or typographical errors. Information (including service details or pricing, if any) may be updated, changed, or removed without notice. We assume no liability or responsibility for any errors or omissions in the content of the Site.

Availability and Security: We do not guarantee that the Site will be available on an uninterrupted, timely, secure, or error-free basis. Scheduled downtime and unexpected outages may occur. We also do not warrant that any defects or errors on the Site will be corrected. Although we implement security measures (as described in our Privacy Policy), we make no warranty that the Site will be free from viruses, malware, or other harmful components, or that any transmission of data to/from the Site will be secure. You understand that internet usage involves inherent risks and that you should use appropriate caution and security measures (such as using secure networks and keeping your software updated).

Third-Party Websites and Content: Our Site may include links to third-party websites or services (for example, links to articles, design resources, social media pages, or client websites we’ve developed). These links are provided for convenience and reference only. We do not endorse, supervise, or have control over any third-party websites. If you access third-party sites via links on our Site, you do so at your own risk. We make no warranties or representations regarding any third-party website’s content, accuracy, or practices. Visiting and interacting with third-party sites is governed by their own terms of use and privacy policies, not ours. Art of Media Design, LLC shall not be responsible or liable for any loss or damage that may arise from your use of any third-party websites or resources.

No Professional Advice: Any advice, recommendations, or information that may be presented on our Site (such as in blog posts or FAQs) are general in nature. They are not a substitute for individualized professional advice. We disclaim any liability for actions you take based on information obtained from the Site. If you need specific professional advice (for example, legal, financial, or technical advice regarding web infrastructure), you should consult a qualified professional.

User Responsibility: You are solely responsible for your use of the Site and any consequences thereof. If you download any materials or content from our Site, you do so at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

Because some jurisdictions do not allow certain warranty disclaimers, some of the above disclaimers may not apply to you. In that event, the disclaimers will apply to the greatest extent permitted by applicable law.

Governing Law

This Agreement (the Terms of Service) and any dispute or claim arising out of or related to it, or to your use of the Site or our services, shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles. By using the Site, you agree that the laws of New York will govern these Terms and any issue that might arise between you and Art of Media Design, LLC.

Jurisdiction and Venue: You further agree that any legal action or proceeding arising under these Terms or related to your use of the Site shall be brought exclusively in the state or federal courts located in the State of New York. You consent to the personal jurisdiction and venue of these courts for the purpose of litigating any such claim, and you waive any objections (such as inconvenience of forum) to the exercise of jurisdiction by those courts. If you are accessing the Site from a location outside the U.S., please be aware that you are expressly agreeing that any disputes will be resolved in the United States under New York law.

International Use: We recognize that our Site may be accessed globally. If you are located outside of the United States, local mandatory consumer protection laws may give you certain rights or remedies. This Governing Law section does not limit any such rights that apply to you as a matter of law. However, to the extent permissible, you agree to the above choice of New York law and forum. We do not submit to the jurisdiction of any other courts voluntarily, and the above choice of forum is intended to be mandatory.

Miscellaneous Provisions

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be eliminated or limited to the minimum extent such that the remainder of the Terms will continue in full force and effect. In other words, the invalid portion will be severed and the rest of the agreement remains valid.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Art of Media Design, LLC.

Entire Agreement: These Terms of Service (together with our Privacy Policy and any additional terms expressly incorporated herein) constitute the entire agreement between you and Art of Media Design, LLC regarding your use of our Site. They supersede any prior or contemporaneous understandings and agreements, whether written or oral, regarding the same subject matter. In case of any conflict between these Terms and any other agreement you have with Art of Media Design (for example, a separate client services contract), the terms of that other agreement will govern as to the conflict, but only in relation to the specific services it covers.

Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.

By using ArtOfMediaDesign.com and our services, you acknowledge that you have read and agree to this Privacy Policy and Terms of Service.
